UNDERSTANDING INJURY LAW

Personal injury law is an area of civil law concerned with providing monetary compensation to victims of accidents or social wrongs. The injured person bringing the lawsuit is called the "plaintiff," and the person or entity allegedly responsible for the injury is called the "defendant." In fatal accidents, the family of the decedent may bring a wrongful death suit against the person or entity responsible for the accident.

In some cases, there may be multiple responsible parties, and the plaintiff may be able to sue all of them to recover the full amount of compensation needed for his or her injuries. The defendant, in turn, may allege that another person or entity was responsible and bring that person or entity into the lawsuit as a cross-defendant.

The burden of proof in personal injury cases is typically lower than the burden of proof for criminal cases arising out of the same actions. This means that you may be able to recover in a personal injury lawsuit, even if the defendant was acquitted of criminal charges arising out of the same conduct. The objective in a personal injury lawsuit is generally to recover monetary compensation, rather than punish the defendant. However, in some cases, punitive damages may be sought and awarded for particularly egregious or malicious misconduct by a defendant.

Meet The Team

KATRINA LAUDERDALE

Katrina earned her Juris Doctor from the University of Baltimore School of Law where she graduated magna cum laude. While in law school, Katrina was a law clerk for two of Baltimore's most prominent personal injury law firms. After graduation, she worked as a government contractor for the U.S. Attorney's Office in Greenbelt. 

Ms. Lauderdale was admitted to the Maryland Bar in 2012. Her primary practice area is civil litigation, with an emphasis on personal injury and workers' compensation. Prior to becoming a founding partner of our firm, Katrina spent two years working for a civil litigation firm in the Baltimore area. 

BENJAMIN THOMPSON

Prior to becoming a founding partner of Lauderdale, Thompson and Warby, LLP, Mr. Thompson ran his own successful legal practice, The Law Practice of Benjamin Thompson, Esq., handling primarily criminal, traffic, juvenile delinquency and Child in Need of Assistance cases. Before entering private practice, Mr. Thompson served as an attorney with the Maryland Office of the Public Defender practicing in its juvenile division. As an Assistant Public Defender, Mr. Thompson fought for his clients in many different types of cases, including traffic offenses, assaults, burglaries, robberies and sex offenses. 

BRADLEY WARBY

Bradley Warby was raised in Central Virginia and moved to Maryland after being accepted to the Maryland Bar in 2009. Prior to becoming a founding partner of our firm, he maintained a tireless solo criminal defense practice since 2009 in which he defended over 800 individuals accused of crimes.  He has a record of success, with not guilty findings in everything from the most basic domestic violence charges to the most serious felony cases, including two not guilty findings in cases in which his clients were facing life in prison.
